Ontario Travel Wholesaler Disclaimer & Terms

IMPORTANT NOTICE: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY CONTAIN A MANDATORY ARBITRATION CLAUSE AND A WAIVER OF CLASS ACTIONS.

1. General Information and TICO Registration

[Campbell Travel LTD DBA SunspotsHolidays] is a registered travel retailer/ wholesaler under the Travel Industry Act, 2002 with the Travel Industry Council of Ontario (TICO). Our TICO registration number is [TICO Registration Wholesale= 50013229 Retail = 1030981] . We act as an intermediary or principal in packaging travel services (including, but not limited to, flights, accommodations, tours, and car rentals) from various third-party suppliers ("Suppliers").

2. All-In Pricing

The total price displayed for all travel services includes all taxes, fees, levies, and other charges, in compliance with Ontario Regulation 26/05 . You will not be charged any additional mandatory fees after booking, except for changes you request.

3. Role of the Wholesaler and Supplier Responsibility

We carefully select our Suppliers; however, we are not the direct provider of the underlying travel services (e.g., the airline flight, the hotel room). Consequently, we are not liable for any acts, omissions, breaches, or negligence of any independent Supplier, or for any injuries, damages, or losses resulting therefrom.

  • The Suppliers provide their services in accordance with their own terms and conditions, which may limit their liability (e.g., by reference to international conventions like the Montreal Convention for air travel).
  • We are not responsible for any Supplier's failure to comply with applicable laws or any third party's acts or omissions.

4. Limitation of Liability

To the maximum extent permitted by the Travel Industry Act, 2002 and applicable law, our liability, and that of our employees, agents, and affiliates, is limited as follows:

  • We act as your agent in booking travel services. For any claims arising from the performance of the travel services themselves, you agree to pursue remedies directly against the Supplier.
  • In all cases, our total liability to you shall not exceed the total amount paid by you for the specific booking giving rise to the claim.
  • We shall not be liable for any indirect, consequential, or punitive damages, or for lost profits or opportunities.

5. Force Majeure

We shall not be deemed in breach of these terms or otherwise liable to you for any failure or delay in performance resulting from circumstances beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, civil unrest, government actions, natural disasters, epidemics, pandemics, or any event commonly referred to as force majeure . If a force majeure event occurs, we will work with Suppliers to offer alternative arrangements where possible, but you acknowledge that refunds may be subject to the policies of the Suppliers involved.

6. Travel Documentation and Insurance

You are solely responsible for ensuring you have valid passports, visas, health certificates (including vaccinations), and other required travel documents. We recommend you consult the relevant embassy or consulate for entry requirements .

Insurance: We strongly recommend that you purchase comprehensive travel insurance, including trip cancellation, trip interruption, medical evacuation, and out-of-province health insurance, immediately upon booking. We are not liable for any costs you incur due to lack of adequate insurance .

7. Dispute Resolution and Governing Law

These terms and conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

  • Informal Resolution: Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at info@sunspotsholidays.com
  • Binding Arbitration: Any dispute arising out of or relating to these terms, or your booking, that cannot be resolved informally, shall be resolved by binding arbitration administered by [e.g. ADR Institute of Canada] . The arbitration shall take place in Toronto, Ontario .
  • Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive your right to participate in a class action lawsuit or class-wide arbitration.

8. Changes and Cancellations

Cancellation and change requests are subject to the terms and conditions of the Suppliers and our administrative fees, which may be up to 100% of the booking cost as the departure date approaches. All requests must be submitted in writing.

9. Severability

If any part of this disclaimer is found to be unenforceable, the remaining provisions will remain in full force and effect.
